Our Process for Complex Commercial Claims

Assessment starts with the full document trail. Policy wordings, proposal forms, surveyor reports, fire investigation reports, police reports, financial statements, invoices, photographs, and correspondence all get reviewed together, not in isolation. The objective is to establish, early, whether a rejection or reduction is actually justified under the policy or whether it is being asserted without full technical support.

Policy interpretation is treated as a specialist exercise. Commercial policies carry warranties, endorsements, conditions precedent, and disclosure obligations that materially change what is and is not covered. We examine these clauses against applicable IRDAI regulations and relevant judicial precedents, because a single misapplied exclusion can be the difference between a full settlement and a rejected claim.

Investigation is tailored to the class of business. A fire claim requires analysis of cause, extent of damage, asset valuation, stock records, and electrical and fire department reports. A marine claim requires scrutiny of cargo documentation, packing condition, and bill of lading records against the survey findings. An engineering claim requires assessment of machinery failure history and repair estimates. A cyber claim requires review of security logs, forensic reports, and business interruption losses tied to the incident timeline. Each class of business has its own failure points, and we investigate accordingly.

We build the strategy the case actually needs. Depending on the facts, this might mean a technical engineering argument, a financial loss reconstruction, an alternate policy interpretation backed by regulatory precedent, or an independent expert opinion to counter the insurer's own surveyor. No two commercial claims are argued the same way.

Negotiation happens at the level the claim deserves. We engage directly with claims teams and surveyors, respond to technical queries, submit supplementary evidence, and negotiate settlement figures, rather than leaving a business to respond to a claims adjuster's conclusions without a technical counter-view.

Escalation is available when negotiation stalls. For claims that do not resolve through direct engagement, we guide clients through internal grievance processes, regulatory complaints, Ombudsman proceedings where applicable, or other available dispute resolution routes.
